About these terms

These terms apply to your use of Blagger, a personal activity and time-tracking application operated by Samantha Kerr.

By creating an account or using Blagger, you agree to these terms. If you do not agree, do not use the service.

Private beta

Blagger is currently an early-release service provided to invited users for testing and feedback.

Features may be incomplete, change without notice or occasionally behave unexpectedly. Your experience and feedback will help improve the service.

Your account

You must:

  • provide accurate account information;
  • keep your password secure;
  • not share your account with another person;
  • tell Samantha promptly if you believe somebody else has accessed your account;
  • use only accounts and invitation links intended for you.

You are responsible for activity performed through your account unless it results from a failure by Blagger to protect the service appropriately.

Acceptable use

You may use Blagger for lawful personal or business time tracking.

You must not:

  • use Blagger for an unlawful, fraudulent or abusive purpose;
  • attempt to access another user's account or information;
  • interfere with the operation or security of the service;
  • probe, scan or test the service for vulnerabilities without prior permission;
  • introduce malware or other harmful material;
  • use automated requests in a way that places an unreasonable load on the service;
  • copy, modify or redistribute the application except where permitted by law or by a separate licence.

If you discover a security weakness, please report it privately using the contact details above.

Information you enter

You retain ownership of the activity names, notes, periods and other information you enter into Blagger.

You give Blagger permission to store, process, display and back up that information only as needed to provide, secure and maintain the service.

You are responsible for the information you enter. Do not enter information that is unlawful or that infringes another person's rights. Take particular care when recording personal or sensitive information about somebody else.

How personal information is handled is explained in the Privacy notice.

Availability and changes

Blagger is provided with reasonable care, but uninterrupted or error-free availability cannot be guaranteed.

The service may occasionally be unavailable because of maintenance, faults, security work, internet connectivity or circumstances outside Samantha's reasonable control.

Features may be added, changed or removed during the private beta. Reasonable notice will be given where a change is likely to have a significant adverse effect on users, when practical.

Backups and important information

Operational backups may be taken to help recover the service following a fault. These backups are not a guaranteed archive for individual users and may not allow a particular item or earlier version to be restored.

Do not rely on Blagger as the only copy of information that would be difficult or costly to replace.

Suspension and closure

Access may be suspended or an account may be closed where reasonably necessary to:

  • protect Blagger or its users;
  • investigate suspected misuse or a security incident;
  • comply with a legal obligation;
  • respond to a serious or repeated breach of these terms;
  • discontinue the private beta or the service.

Where practical, Samantha will explain the reason and allow a reasonable opportunity to retrieve information before permanent closure.

You may ask for your account and associated information to be deleted by contacting blagger.support@gmail.com.

Responsibility for loss

Nothing in these terms excludes or limits responsibility where doing so would be unlawful, including responsibility for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence.

Blagger is an early-release time-tracking tool. It should not be relied upon for safety-critical, medical, legal, tax, payroll or financial decisions without independently checking the relevant information.

Samantha is not responsible for loss that:

  • was not reasonably foreseeable;
  • results from circumstances outside her reasonable control;
  • results from your breach of these terms or failure to keep your account secure;
  • relates to a business opportunity, anticipated profit or indirect business loss.

Your statutory rights are not affected.

Changes to these terms

These terms may be updated as Blagger develops or where legal, security or operational requirements change.

The updated terms will be published here with a revised date. If a change materially affects existing users, reasonable steps will be taken to draw attention to it.

Governing law

These terms are governed by the law of England and Wales.

The courts that may hear a dispute will be determined by applicable law. Nothing in these terms removes any right you may have to bring a claim in another part of the United Kingdom where you live.
